1- Purpose
beerens.bigwonder.shop Website is intended to present and give the opportunity to purchase works from artists (hereinafter the “Sellers”) to any user (hereinafter the “Users”) of the site (potential “Buyers”).
These general terms and conditions of sale (hereinafter the “GTS”) exclusively govern the terms and conditions of online sale of the Works present on the www.allstar-art.com website, and define the rights and obligations of the parties, any user, whether a customer or not (hereinafter the “User” or the “Customer” or “you”) in this relationship.
The GCS apply to all sales of Products made through the Service between the Seller and the Buyer. They are intended to govern the relationship between the Buyer and the Seller(s), who is (are) the sole seller(s) of the Works and is (are) solely liable for the obligations arising therefrom, excluding those arising between the Buyers and bigwonder.shop / We Are So Art Addict or between the Sellers and bigwonder.shop / We Are So Art Addict.
Sales made through the Website are concluded directly between the Buyer and the Seller. bigwonder.shop / We Are So Art Addict is in no way a reseller of the Works offered by the Sellers through the Website.
bigwonder.shop / We Are So Art Addict is not the Seller of the Products purchased through the Service. The Products may therefore not be taken back or exchanged by bigwonder.shop / We Are So Art Addict.
The General Terms and Conditions of Sale may be subject to subsequent modifications. The contractual relationship between bigwonder.shop / We Are So Art Addict and Clients is governed by the General Terms and Conditions of Sale available on the website on the date of the order.
It is specified that the purchase of Products on the Site is reserved for natural persons over eighteen (18) years of age and with full legal capacity.
bigwonder.shop / We Are So Art Addict also reserves the right to refuse any order of an abnormal nature.
2- Orders
Any order for a Product(s) offered on the Site implies the User’s full and complete adherence to these General Terms and Conditions of Sale.
You can place an order on the Site 24 hours a day, 7 days a week.
The order process consists of four (4) successive steps. Once your choice of Product(s) has been made and your basket validated, you must :
- Create an account or identify yourself ;
- Choose your delivery and/or invoicing address;
- Choose your method of payment;
- Accept the General Terms and Conditions of Sale by ticking the box provided for this purpose on the summary page of your order.
The payment formalises in a firm and definitive manner the sales contract between you and bigwonder.shop / We Are So Art Addict.
In the event that the Work is no longer available, an email informing the Purchaser will be sent within 48 hours, resulting in the cancellation of the order.
Article 7 “Right of withdrawal” describes the means available to you to withdraw from the order.
3- Order confirmation and follow-up
Once your order has been confirmed, and on the condition that you have obtained prior authorisation to debit your account in accordance with the provisions of article 4 entitled “Sale price and payment terms”, the Seller will proceed with its dispatch.
An e-mail will inform you of its dispatch. The invoice is then at your disposal in your “My Account” area.
4- Selling price and method of payment
Payment for purchases made through the Service may be made by credit card via the payment services made available by bigwonder.shop / We Are So Art Addict, which shall collect the corresponding amount in the name and on behalf of the Seller.
The sale prices are indicated in Euros and include all taxes (including VAT), excluding delivery costs. The Value Added Tax (VAT) is that which is applicable and in force on the day of the order on French territory.
The prices applied are those appearing on the Site at the time the order is validated.
The prices displayed on the Site do not include delivery costs. The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer.
The Seller shall not be obliged to deliver the Works or Products ordered by the Customer if the price has not been paid in full beforehand.
If customs duties, local taxes or import duties are payable, these duties shall be borne by the Purchaser and shall be his sole responsibility, both in terms of declarations and payments to the competent authorities and/or bodies. It is the Buyer’s responsibility to obtain information from the competent authorities.
Ownership of the Works or Products is only transferred to the Customer after full payment of the price by the latter. In the event of non-payment of the full price, the sale will be automatically cancelled and the work will be put back on sale on the site.
5- Payment security
bigwonder.shop / We Are So Art Addict has adopted the Stripe solution for means of payment, using the SSL (Secure Socket Layer) and 3D Secure encryption process, in order to protect all data related to the means of payment as effectively as possible, and that at no time does the Customers’ banking data transit through the bigwonder.shop / We Are So Art Addict computer system.
In accordance with our commitment to payment security, we inform you that bigwonder.shop / We Are So Art Addict verifies the reliability of the information entered when registering an order.
6- Deliveries
The delivery of the works or products ordered is made to the address indicated by the Buyer at the time of the order.
The delivery costs for each order are fixed and per Seller. In the case of sales involving several Sellers, several delivery charges will be applied. Works or products having several shipping locations.
The Sellers carry out the packaging and shipping of the order and are solely responsible for it. bigwonder.shop / We Are So Art Addict cannot be held liable in any way in the event of failure on the part of the Seller.
The Sellers undertake to make their best efforts to dispatch your orders as quickly as possible and in the order in which they were placed. A period of seven (7) to fifteen (15) working days after confirmation of the order, and in any event within thirty (30) days after confirmation of an order.
The Sellers undertake to make their best efforts to deliver within the times communicated, however delivery times may be extended due to unforeseen events. In the event that the delivery period exceeds thirty (30) days, the Customer shall be entitled to cancel the order by registered letter with acknowledgement of receipt or in writing on any other medium.
Upon receipt of the order, the Purchaser undertakes to check the condition of the work, and to make any reservations in writing and without delay, within 48 hours at the latest, to bigwonder.shop / We Are So Art Addict , which will forward them to the Seller.
7- Right of cancellation
Pursuant to Article L.121-21 (law of 17 March 2014 relating to consumption) of the French Consumer Code, the Buyer has a period of 14 days from delivery of the Work to exercise his right of cancellation with the Seller, free of charge and without reason.
The Purchaser shall exercise his right of cancellation with bigwonder.shop / We Are So Art Addict by sending an email via the contact form.
bigwonder.shop / We Are So Art Addict will then deal with the Buyer’s cancellation request and will proceed to reimburse it within 14 days of the date on which bigwonder.shop / We Are So Art Addict has been informed of the exercise of the Buyer’s right of cancellation and once the Seller has notified bigwonder.shop / We Are So Art Addict of the correct receipt of the work or product.
Reimbursement shall cover the price of the work paid by the Buyer as well as the costs of return, excluding customs duties payable on delivery.
In the case of a purchase by leasing, the signature of the delivery note constitutes a waiver of the right of cancellation.
bigwonder.shop / We Are So Art Addict reserves the right not to take back, at its sole discretion, nor to refund in the event that the works or products returned are damaged.
8- Intellectual property
The Seller guarantees that he is the author of the Work assigned or that he fully owns the rights thereto, that the Work does not in any way contravene the laws, regulations and standards in force and that it does not infringe the rights of third parties.
He undertakes to guarantee bigwonder.shop / We Are So Art Addict and the Purchaser in the event of recourse by a third party in respect of the Work assigned, within the framework of the guarantee of eviction.
At the time of sale, however, the Seller retains the moral rights to the work sold and the rights associated with its reproduction.
The Seller transfers to the Buyer the material support of the work and his representation rights on the work.
9- Personal data
In addition to article 5 of the GCU, the Buyer and the Seller are informed that all data collected within the framework of the Service when placing orders are processed by bigwonder.shop / We Are So Art Addict for the purposes of processing said orders.
The information and data of the Purchasers relating to the delivery are transmitted by bigwonder.shop / We Are So Art Addict to the Sellers for the sole purpose of enabling them to ship the Works ordered. It may not be used for any other purpose.
In the event of any difficulty concerning the processing of this data, the Buyer and the Seller may contact bigwonder.shop / We Are So Art Addict directly, under the conditions laid down, as the case may be, in the GCU.
The personal data provided by the Purchaser shall be destroyed no later than 12 months after deletion of the Purchaser’s account.
bigwonder.shop / We Are So Art Addict reserves the right to retain certain data in order to justify, where applicable, the perfect performance of its contractual or legal obligations. The data thus retained shall be limited to what is strictly necessary for the operation of the service.
10- Partial nullity
If one or more stipulations of these GTS are held to be invalid or declared as such in application of a law, regulation or final decision of a competent court, the other stipulations will not be affected.
11- Duration and validity
The user is subject to these GTS from the time of purchase on the Site until the deletion of his account.
bigwonder.shop / We Are So Art Addict reserves the right to modify these GTS. Any modification shall take immediate effect for the Works and Products as soon as they are placed online on the Website.
The applicable GTS are those in force on the day the Purchaser uses the services of the Website.
12- Applicable law – Jurisdiction
These General Terms and Conditions of Sale and the contractual relationship between bigwonder.shop / We Are So Art Addict and the User or the Purchaser and the seller are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.
However, bigwonder.shop / We Are So Art Addict undertakes to seek an amicable solution before any legal action is taken.
